Welcome to Chateau Zhan (“Chateau Zhan,” “Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, online store, and any related services (collectively, the “Services”), as well as purchases made through the Services.

By accessing or using our Services, placing an order, purchasing our products, or otherwise interacting with our Services, you agree to be bound by these Terms and any policies incorporated herein by reference. If you do not agree to these Terms, please do not use our Services.

1. GENERAL CONDITIONS & ELIGIBILITY

1.1 Eligibility

By using our Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have obtained the consent of your parent or legal guardian where permitted by applicable law.

1.2 Accuracy of Information

You agree to provide current, complete, and accurate purchase, billing, shipping, and account information for all transactions made through our Services.

You are responsible for ensuring that all information provided in connection with an order, including the shipping address and contact information, is accurate.

1.3 Modifications

We reserve the right to update, modify, or replace any portion of these Terms at any time by posting the revised Terms on our website.

Unless otherwise required by applicable law, changes will become effective when posted. Your continued use of the Services following the posting of revised Terms constitutes your acceptance of those changes.

2. INTELLECTUAL PROPERTY RIGHTS

2.1 Ownership

All content owned by or licensed to Chateau Zhan and made available through the Services—including, without limitation, the Chateau Zhan name, logos, trademarks, trade dress, product designs, handbag designs, accessories, architectural objects, decorative-art designs, graphics, photographs, artwork, illustrations, text, packaging concepts, website content, and other creative materials—is protected by applicable United States and international copyright, trademark, design, and other intellectual property laws.

2.2 Product Designs

Chateau Zhan’s original product designs, including all boutique lines and other original creations, may embody proprietary artistic, ornamental, structural, and design elements.

Nothing contained in the Services grants any license or right to reproduce, manufacture, imitate, adapt, distribute, commercially exploit, or create derivative works based upon such designs except with the prior written authorization of Chateau Zhan.

2.3 Restrictions

Except as expressly permitted by us in writing, you may not reproduce, duplicate, copy, modify, manufacture, distribute, sell, resell, publish, display, commercially exploit, or otherwise use any protected portion of our products, designs, branding, photographs, artwork, or website content.

3. PRODUCTS, CRAFTSMANSHIP & PRICING

3.1 Artisanal Craftsmanship & Natural Variations

Chateau Zhan products may be individually crafted or finished by artisans and may incorporate natural or handcrafted materials, including leather, wood, gemstones, mother-of-pearl, lacquer, textiles, metal hardware, and other specialty materials.

Because of the inherent characteristics of natural materials and artisanal production, variations may occur in grain, texture, pattern, color, tone, finish, stitching, dimensions, placement, surface characteristics, or other details.

Such variations are part of the individual character of handcrafted and natural-material products and, by themselves, shall not constitute manufacturing defects.

3.2 Product Images & Display

We make reasonable efforts to display our products, colors, proportions, materials, and details accurately.

However, actual appearance may vary slightly due to lighting, photography, screen settings, natural materials, handcrafted production, or other factors beyond our reasonable control.

Product images are provided for reference, and minor differences between photographs and the physical product that arise from these factors shall not, by themselves, constitute defects.

3.3 Pricing

Unless otherwise stated, prices displayed through our U.S. Services are denominated in U.S. Dollars (USD).

Prices may change without notice. Any applicable sales taxes, shipping charges, or other charges will be disclosed or calculated as applicable during checkout.

3.4 Order Acceptance

Submission of an order does not constitute our acceptance of that order.

We reserve the right, subject to applicable law, to refuse, limit, or cancel an order before fulfillment for legitimate reasons, including product unavailability, pricing or description errors, suspected fraud, unauthorized transactions, payment issues, or other circumstances that reasonably prevent fulfillment.

If we cancel an order after payment has been collected, we will refund the applicable amount paid for the cancelled portion of the order.

3.5 Availability

Because certain Chateau Zhan products are produced in limited quantities or through artisanal processes, availability is not guaranteed.

An item appearing on our website does not guarantee that it will remain available for purchase.

4. SHIPPING, DELIVERY, RISK OF LOSS & INTERNATIONAL ORDERS

4.1 Shipping

Shipping and delivery estimates are provided for convenience and are estimates only unless expressly stated otherwise.

Delays may occur because of carriers, customs processing, weather, transportation disruptions, force majeure events, or other circumstances outside our reasonable control.

4.2 Delivery

For purposes of calculating applicable return, exchange, and warranty-related periods under our policies, an order will generally be considered delivered on the date the applicable carrier records the shipment as successfully delivered, subject to applicable law and evidence demonstrating otherwise.

4.3 Risk of Loss

Except to the extent otherwise required by applicable law, risk of loss remains with Chateau Zhan until the order is delivered to the shipping address provided by the customer.

After confirmed delivery, responsibility for the product transfers to the customer, except with respect to rights available under our warranty, return policies, or applicable law.

4.4 Incorrect Shipping Information

Customers are responsible for providing accurate shipping information.

Chateau Zhan is not responsible for delays or failed deliveries resulting from inaccurate or incomplete information provided by the customer, except to the extent otherwise required by applicable law.

4.5 International Orders & Import Duties

For international deliveries, the recipient may be responsible for import duties, customs tariffs, VAT, taxes, brokerage charges, clearance fees, or other charges imposed by the destination country or relevant authorities, unless otherwise expressly stated at checkout.

Customers are responsible for complying with applicable import requirements in their jurisdiction.

5. RETURNS, EXCHANGES & WARRANTY

5.1 General Return & Exchange Conditions

Except for products expressly identified as ineligible for return or exchange, eligible products may be returned or exchanged within 7 calendar days after delivery, subject to these Terms and our applicable Return Guidelines.

Returned merchandise must be in the same condition in which it was received and must not have been used, worn, altered, damaged, repaired, or otherwise modified.

All original packaging, boxes, accessories, tags, documentation, dust bags, certificates, and other materials supplied with the product must be returned together with the product.

Original or authenticity tags must remain attached where applicable.

Chateau Zhan reserves the right to inspect returned merchandise before approving a refund or exchange.

5.2 Manufacturing Defects

If a product has a qualifying manufacturing defect present upon receipt, the customer must notify Chateau Zhan within 7 calendar days after delivery.

After inspection and confirmation of the qualifying defect, the customer may be eligible for a full refund or replacement, as appropriate. Chateau Zhan will cover applicable authorized return and replacement shipping costs for confirmed qualifying manufacturing defects.

Natural variations and characteristics described in Section 3.1 are not, by themselves, manufacturing defects.

5.3 Returns for Personal Reasons

For an otherwise eligible return requested for personal reasons within 7 calendar days after delivery, the customer may request a refund subject to a 15% restocking and handling fee.

The original outbound shipping charge, if any, is non-refundable except where otherwise required by applicable law.

Eligible customers may alternatively request one exchange, subject to product availability and our Return Guidelines.

Authorized return transportation will be arranged in accordance with our Return Guidelines.

5.4 Exchange Period — Days 7 Through 15

After the initial return period has expired, eligible products may qualify for one exchange from the 7th through the 15th calendar day after delivery, subject to product condition, availability, and our Return Guidelines.

Refunds for personal reasons are not available during this extended exchange period.

5.5 Artisan Care — Days 15 Through Months 7

From the 15th day through the 7th month calendar day after delivery, eligible products may qualify for complimentary craftsmanship assessment and repair services for covered issues under our Artisan Care program.

Eligibility will be determined following inspection by Chateau Zhan.

5.6 Seven-Month Limited Warranty

Chateau Zhan provides a 7-month limited warranty beginning on the date of delivery for qualifying manufacturing defects and covered craftsmanship issues under normal use.

During the applicable warranty period, Chateau Zhan will cover authorized repair services and associated authorized shipping costs for qualifying warranty claims.

This limited warranty does not cover normal wear and tear, scratches, staining, discoloration resulting from use or environmental exposure, accidental damage, improper storage, misuse, abuse, neglect, unauthorized modification, unauthorized repair, or damage resulting from failure to follow applicable care instructions.

After expiration of the 7-month warranty period, repair or shipping services may remain available at the customer's expense, subject to assessment and availability.

Nothing in this warranty limits any non-waivable rights or remedies available to consumers under applicable law.

5.7 Final Sale, Personalized & Bespoke Products

Products expressly identified on the applicable product page or at checkout as “Final Sale,” as well as personalized, bespoke, or custom-made products, are not eligible for return or exchange except in the event of a qualifying defect or where otherwise required by applicable law.

A product's status as a limited-edition product alone does not make it Final Sale unless it is specifically identified as such.

5.8 Return Authorization

Customers must contact Chateau Zhan and follow our return authorization procedures before sending merchandise back.

Unauthorized returns may be refused or returned to the sender.

Additional procedural details may be provided in our separate Return & Exchange Policy / Return Guidelines, which are incorporated into these Terms by reference.

6. PROHIBITED USES

You may not use our Services, website, products, intellectual property, or content:

for any unlawful or fraudulent purpose;
to solicit or encourage unlawful activity;
to infringe or violate our intellectual property rights or the rights of any third party;
to submit materially false, fraudulent, or misleading information;
to interfere with or circumvent security features of the Services;
to upload or transmit viruses, malicious code, or other harmful technology;
to scrape, reproduce, or commercially exploit our website or content without authorization; or
to use our designs, photographs, branding, or other proprietary materials to manufacture, market, or sell unauthorized reproductions or imitations.

We reserve the right to restrict or terminate access to the Services for violations of this Section, subject to applicable law.

7. DISCLAIMER & LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Chateau Zhan shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to the use of, inability to use, or purchase of products through the Services.

To the fullest extent permitted by applicable law, Chateau Zhan's aggregate liability arising from a particular product or transaction shall not exceed the amount actually paid by the customer to Chateau Zhan for the product or transaction giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or limits any non-waivable consumer rights available under applicable law.

8. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Chateau Zhan and its affiliates, officers, directors, employees, representatives, and agents from third-party claims, liabilities, damages, losses, and reasonable attorneys' fees arising from your material breach of these Terms, unlawful misuse of the Services, or violation of the rights of a third party.

9. GOVERNING LAW & JURISDICTION

These Terms and any dispute arising out of or relating to the Services or transactions governed by these Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law principles, except to the extent otherwise required by applicable law.

Subject to any non-waivable rights available under applicable law, any legal action or proceeding arising out of or relating to these Terms shall be brought in the applicable state or federal courts located in Los Angeles County, California, and the parties consent to the jurisdiction of such courts.

Nothing in this Section is intended to prevent a consumer from exercising any right to bring an eligible matter in small claims court or any other right that cannot lawfully be waived.

10. SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.

11. NO WAIVER

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

12. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return & Exchange Policy, Shipping Policy, and any other policies or notices expressly incorporated by reference, constitute the agreement between you and Chateau Zhan concerning your use of the Services and applicable purchases, except where separate written terms expressly apply.

If there is a conflict between these Terms and a product-specific policy expressly presented to you at the time of purchase, the more specific terms will govern to the extent permitted by applicable law.
